Welcome to Elegy & Ivy. By visiting our website, placing an order, or purchasing from our shop, you agree to the following Terms of Service.

Please read these terms carefully before using this website or purchasing from Elegy & Ivy.

Overview

Elegy & Ivy creates custom, made-to-order, and historically inspired decorative products, including gravestone props, Halloween display pieces, haunt decor, film props, photography props, and related items.

All products are intended for decorative, theatrical, seasonal, display, film, photography, or prop use only. Products are not intended for use as real grave markers, cemetery monuments, structural objects, toys, safety equipment, or permanent outdoor fixtures.

By using this website or placing an order, you agree to these Terms of Service, along with our Shipping Policy, Refund and Return Policy, Privacy Policy, and any other policies posted on this website.

Products and Descriptions

We do our best to describe and photograph products accurately. However, because Elegy & Ivy items are handmade, custom-made, made to order, or individually finished, slight variations may occur.

Variations may include, but are not limited to:

Color
Texture
Finish
Distressing
Weathering
Moss, lichen, or aging effects
Lettering placement
Carving or surface details
Dimensions
Overall appearance

These variations are part of the handmade and custom-finished nature of the work and are not considered defects.

Product photos may show examples of previous work, sample finishes, staged displays, or custom pieces. Final products may vary depending on the selected options, materials, order details, and artistic finishing process.

Orders

By placing an order, you agree that all information submitted is accurate and complete, including your name, shipping address, email address, product selections, custom wording, spelling, dates, punctuation, and any other order details.

Customers are responsible for reviewing all custom details before submitting an order. Elegy & Ivy is not responsible for customer-submitted errors once production has begun.

We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to suspected fraud, incorrect pricing, unavailable materials, production limitations, unsafe requests, inappropriate custom wording, or requests that fall outside the intended use of our products.

Custom and Made-to-Order Items

Most Elegy & Ivy products are custom-made, made to order, or finished individually. Production may begin shortly after an order is placed.

Because of this, custom and made-to-order items are generally not eligible for cancellation, return, or refund once production has started, except as determined by Elegy & Ivy on a case-by-case basis.

Custom orders may require additional communication, design approval, reference materials, or timeline confirmation. If a customer does not respond to required communication in a timely manner, production or shipment may be delayed.

Turnaround and Shipping

Production time is separate from shipping time.

Unless a rush option is selected and confirmed, please allow approximately one week for production and one additional week for shipping.

Shipping times are estimates and are not guaranteed unless specifically provided by the carrier. Elegy & Ivy is not responsible for delays caused by carriers, weather, holidays, incorrect addresses, customs, supply delays, or circumstances outside our control.

Rush order options may be available for eligible products. Rush fees shorten the production timeline only and do not include the cost of expedited shipping unless expressly stated.

Pricing and Payment

Prices are listed in U.S. dollars unless otherwise stated.

We reserve the right to change prices, product offerings, shipping rates, rush fees, and availability at any time without notice.

Payment is due at checkout. Orders will not begin production until payment has been received.

In the event of an error in pricing, product information, discount, shipping calculation, or availability, we reserve the right to correct the error and cancel or modify the order if necessary.

Cancellations

Cancellation requests are reviewed on a case-by-case basis.

Because custom work may begin shortly after an order is placed, cancellations are not guaranteed. If materials have been ordered, design work has begun, production has started, or a rush order has been accepted, the order may not be eligible for cancellation or may only be eligible for a partial refund.

Returns and Refunds

Returns and refunds are handled according to our Refund and Return Policy.

Because most Elegy & Ivy items are custom-made, personalized, made to order, or individually finished, returns are generally not accepted unless there is an issue with the order.

Original shipping costs and rush processing fees are non-refundable unless otherwise agreed.

Damaged, Lost, or Delayed Packages

If an item arrives damaged, customers must contact Elegy & Ivy within 3 days of delivery with photos of the item, packaging, and shipping label.

Please keep all original packaging while the issue is being reviewed.

Elegy & Ivy is not responsible for carrier delays once an order has shipped. Lost or damaged package claims will be reviewed case by case and may depend on the carrier’s claim process.

Product Use and Safety

Elegy & Ivy products are decorative props and should be handled with care.

Customers are responsible for safely displaying, securing, installing, storing, and handling all products after delivery. Products should not be used in a way that creates a safety hazard.

Products should be kept away from open flames, unsafe heat sources, standing water, high winds, and conditions that may damage the item or create risk.

Elegy & Ivy is not responsible for injury, damage, loss, or other issues resulting from improper handling, installation, storage, display, modification, weather exposure, or misuse.

Outdoor Display

Some products may be suitable for temporary outdoor display depending on the item, finish, and conditions.

Outdoor use may expose products to weather, moisture, sunlight, wind, dirt, insects, and temperature changes. These conditions may affect appearance, structure, finish, or lifespan.

Customers are responsible for deciding whether a display location is safe and appropriate.

Intellectual Property

All Elegy & Ivy product designs, gravestone layouts, artwork, photographs, written content, branding, logos, listings, product descriptions, original design concepts, patterns, templates, digital files, prototypes, production methods, creative processes, techniques, workflows, and final artistic interpretations are the property of Elegy & Ivy unless otherwise stated.

No Elegy & Ivy content, images, product designs, gravestone layouts, artwork, written materials, methods, processes, techniques, digital files, templates, product concepts, or production approaches may be copied, reproduced, reverse engineered, resold, modified, distributed, taught, recreated, or used for commercial purposes without written permission from Elegy & Ivy.

Custom work may be inspired by historic cemetery art, traditional gravestone motifs, period design, or customer-provided references, but Elegy & Ivy retains ownership of its original designs, layouts, creative methods, production processes, product photography, digital assets, and final artistic interpretations unless otherwise agreed in writing.

Purchase of an Elegy & Ivy product does not transfer ownership of any design rights, intellectual property rights, production methods, digital files, templates, layouts, artwork, or creative processes used to create the item.

Customer-Provided Materials

If you provide images, text, references, sketches, names, dates, epitaphs, logos, symbols, or other materials for a custom order, you confirm that you have the right to use those materials.

You agree not to submit materials that infringe on another person’s copyright, trademark, privacy rights, publicity rights, or other legal rights.

Elegy & Ivy may refuse custom requests that include copyrighted characters, protected logos, trademarked phrases, offensive content, hateful content, or other material we determine is inappropriate or legally risky.

Custom Wording and Design Requests

Elegy & Ivy reserves the right to refuse custom wording, design requests, or inscriptions for any reason.

This may include, but is not limited to, requests involving threats, harassment, hate speech, explicit content, impersonation, copyrighted material, trademarked material, or wording that could reasonably be mistaken for a real grave marker or official memorial.

Website Use

You agree not to use this website for unlawful, harmful, fraudulent, or abusive purposes.

You may not attempt to interfere with the website, access restricted areas, copy website content for commercial use, upload harmful code, scrape content, or use the site in a way that damages Elegy & Ivy or other users.

Third-Party Services

This website may use third-party services, including payment processors, shipping carriers, website platforms, analytics tools, and apps.

Elegy & Ivy is not responsible for the policies, actions, errors, outages, or practices of third-party services. Use of those services may be subject to their own terms and privacy policies.

Limitation of Liability

To the fullest extent permitted by law, Elegy & Ivy is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of this website, purchase of products, product display, product handling, shipping delays, carrier issues, or misuse of products.

Elegy & Ivy’s total liability for any claim related to an order will not exceed the amount paid for that order.

Changes to These Terms

Elegy & Ivy may update these Terms of Service at any time. Changes will be posted on this page with the updated effective date, if applicable.

Continued use of the website or purchase from Elegy & Ivy after changes are posted means you accept the updated terms.
